These Terms and Conditions (“Terms”) govern your booking and use of the tours and services offered by Paul Polano Tours (“Paul Polano Tours”, “we”, “us” or “our”). Please read them carefully. By requesting a quote, making a booking or joining one of our tours, you confirm that you have read, understood and agreed to these Terms on behalf of yourself and everyone in your party.

1. About us

Paul Polano Tours is a Cape Town–based tour company offering personalised, professional private and shared tours to local and international guests. Our experienced guides aim to show you the best of Cape Town and the surrounding region while sharing their knowledge and passion.

2. Quotes and rates

All rates quoted are indicative and may vary depending on the season, availability, group size, exchange rates and the specific services included. A quote is only confirmed once it has been issued in writing for your specific tour and dates. Rates may change without notice until your booking is confirmed and paid for. Unless stated otherwise, prices are quoted in South African Rand (ZAR).

3. Bookings

A booking is only confirmed once we have:

  1. Received your booking request and the required details for all members of your party, and
  2. Received the required payment or deposit (see section 4 below), and
  3. Issued you a written confirmation.

It is your responsibility to ensure that all information you provide – including names, dates, pick-up details and contact numbers – is complete and accurate. We are not responsible for problems arising from incorrect information supplied to us.

4. Payment

  • Day tours and shorter experiences: Full payment may be required to confirm your booking, unless otherwise agreed in writing.
  • Multi-day tours and larger bookings: A deposit of [INSERT %, e.g. 25%] may be required to confirm your booking, with the balance due [INSERT NUMBER] days before the tour start date.

We accept payment by [INSERT ACCEPTED PAYMENT METHODS, e.g. card, EFT, PayPal]. Where payment is made by international transfer, any bank or currency-conversion charges are for your account, and the full invoiced amount must reach us net of fees. Your booking is only secured once the agreed payment reflects in our account. Bookings where payment is not received by the due date may be treated as cancelled.

5. Cancellations and refunds by you

All cancellations must be made in writing and are only effective once received by us during our normal office hours. The following cancellation terms apply unless we have agreed otherwise in writing or unless a supplier’s terms differ (see section 7):

Day tours and shorter experiences

Multi-day tours

  • Cancelled [INSERT, e.g. 46–45 days] before travel: [INSERT, e.g. 50% of total cost forfeited]
  • Cancelled less than [INSERT, e.g. 45 days] before travel: [INSERT, e.g. 100% of total cost forfeited]

Any transaction, booking or supplier fees that are non-refundable will not be refunded. No refunds are given for unused portions of a tour, for late arrivals or no-shows, or for changes made after a tour has started.

6. Changes or cancellations by us

We aim to operate every tour as booked. However, we reserve the right to amend, reschedule or cancel a tour where necessary – for example due to weather, safety concerns, insufficient numbers on a shared tour, or circumstances beyond our control. If we cancel a tour for reasons within our control, we will offer you a suitable alternative date or a refund of amounts paid for the cancelled service. We are not liable for any additional costs you may incur, such as flights or accommodation booked separately.

7. Suppliers and third-party activities

Some experiences may include services provided by independent third parties, such as attractions, restaurants, accommodation, and adventure or air activities. These suppliers may have their own terms, conditions and cancellation policies, which will apply in addition to ours. Where a supplier’s terms differ from ours, or during peak and festive seasons, we will let you know before you book. We act as an intermediary in arranging these services and are not liable for the acts, omissions or default of independent suppliers.

8. Weather-dependent activities

Some activities depend on suitable weather. Where a weather-dependent activity forms part of a longer tour, we reserve the right to continue with the rest of the tour. Where an activity is cancelled due to weather, we will, where possible, offer a reschedule or a refund of the affected portion in line with the relevant supplier’s policy.

9. Travel insurance

We strongly recommend that all guests, especially international guests, arrange comprehensive travel insurance covering cancellation, medical emergencies, personal accident, and loss of or damage to baggage and personal belongings. Without adequate insurance, you are solely responsible for any costs arising from cancellations, delays, medical or other emergencies. We are not liable for missed activities resulting from delays or cancellations outside our control, including flight or transport delays.

10. Your responsibilities and conduct

By joining a tour, you agree to:

  • Be ready at the agreed pick-up point and time; we cannot delay a tour for late guests, and no-shows are treated as cancellations
  • Behave responsibly and follow the reasonable instructions of your guide, particularly regarding safety
  • Take care of your own belongings throughout the tour
  • Inform us in writing, at the time of booking, of any special requirements (such as dietary, mobility or medical needs) so that we can try to accommodate them; we cannot be held responsible for requirements not communicated to us in writing

We reserve the right to refuse or discontinue service to any guest whose behaviour is unsafe, unlawful, or disruptive to other guests, our staff or suppliers, without refund.

 

11. Health, fitness and safety

Some tours involve walking, uneven terrain or other physical activity. It is your responsibility to ensure that you and your party are fit and able to participate. Please inform us of any condition that may affect your participation. You take part in all tours and activities at your own risk, to the extent permitted by law.

12. Luggage and personal belongings

We do not accept liability for loss of or damage to luggage or personal belongings carried in our vehicles or left in our care, except where caused by our negligence and to the extent required by law. Where light aircraft are used for any part of a tour, luggage may be subject to weight and packing restrictions, which we will advise in your itinerary.

13. Damage to vehicles

You are responsible for any damage caused by you or members of your party to our vehicles or equipment, beyond fair wear and tear, and you agree to reimburse us for the reasonable cost of repair or replacement.

14. Liability

To the maximum extent permitted by South African law, Paul Polano Tours is not liable for any indirect, incidental or consequential loss, or for any loss, injury, damage or delay arising from circumstances beyond our reasonable control or from the acts or omissions of independent suppliers. Nothing in these Terms excludes or limits any liability that may not lawfully be excluded or limited, including liability under the Consumer Protection Act, 2008.

15. Photographs and media

From time to time, we may take photographs or video during tours for promotional purposes. If you would prefer not to be included, please let your guide know and we will respect your request.

16. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use and protect your information.

17. Force majeure

We are not liable for any failure or delay in performing our obligations where this is caused by events beyond our reasonable control, including but not limited to extreme weather, natural disasters, fire, strikes, civil unrest, pandemics, government action, or transport disruption.

18. Governing law

These Terms are governed by the laws of the Republic of South Africa, and any dispute relating to them will be subject to the jurisdiction of the South African courts.

19. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your booking applies to that booking. The “Last updated” date above shows when these Terms were last revised.

20. Agreement

By booking a tour or service with Paul Polano Tours, you confirm that you have read, understood and accepted these Terms and Conditions on behalf of yourself and all members of your party.
